Terms and Conditions

When making a booking with Tūtira you agree to be bound by the following Terms and Conditions.

1. Booking confirmation and payment

A 30% deposit of your group’s total experience fees is required in order to confirm a booking. When confirming a booking you represent that you are authorised to do so on behalf of all members in your group and are liable for all payments due in relation to the booking. Deposit payments are non-refundable except in the circumstances detailed in (2.) below, and prices are in New Zealand dollars, inclusive of GST.

Full payment for the experience and any additional activities must be made no later than 60 days prior to the commencement of your selected experience. If a booking is made less than 60 days prior to the commencement of your experience, full payment is required in order to secure the booking. If the due full payment is not received 60 days prior to the experience start date the group will be cancelled.

2. Cancellations and refunds 

  • Cancellations that occur more than 60 days prior to an experience start date result in a full refund less the 30% deposit and an administration fee of $200 per group

  • Cancellations that occur between 60 and 31 days prior to an experience start date result in a 50% refund less an administration fee of $200 per group 

  • Cancellations that occur between 30 and 15 days prior to an experience start date result in a 25% refund less an administration fee of $200 per group 

  • Cancellations that occur 14 days or less prior to an experience start date are due no refund 

  • Cancellations that occur as a result of a group or individual group member not being able to join the experience, or the experience not being able to proceed due to government-imposed travel restrictions directly resulting from Covid-19 will be subject to the following terms:

    • If the individual or group cancellation occurs more than 14 days prior to the experience start date, the affected group members will be offered a full refund of all fees paid or a credit to participate in their chosen experience at another available time within 12 months of the cancellation date.

    • If the cancellation occurs 14 days or less prior to the experience start date, the affected group members will be offered a credit to participate in their chosen experience at another available time within 12 months of the cancellation date, but no refund will be due.

We reserve the right to modify the experience itinerary, transport arrangements or or accommodation if necessary due to circumstances beyond our control, and if elements of the experience need to be modified due to weather or other conditions, no refunds are provided. If you or another member of your group need to leave the experience for medical, fitness or any other reason no refunds are provided, and if an experience is reduced in duration voluntarily, no refunds are provided. 

No refunds will be given for missed or unused services such as accommodation, transfers, meals or electric motorbike use.

Every experience requires a minimum of four group members in order to proceed. In the event that this minimum number is not met, we reserve the right to issue booked group members with a full refund or transfer them, with their consent, to another experience date.

3. Travel and trip cancellation insurance

Tūtira does not provide insurance of any kind and we strongly advise you to obtain an appropriate travel insurance policy at the time of booking. We recommend discussing your Tūtira experience with your insurance provider to ensure the right level of cover is established.

While the Accident Compensation Corporation (ACC) provides cover for some medical expenses following an accident it is not a suitable replacement for travel insurance, particularly because it does not cover illnesses, lost or damaged property or travel disruption. We encourage you to purchase travel disruption or cancellation insurance, which can provide cover in the event that you or any member of your group have to cancel your participation in the experience at short notice due to unforeseen circumstances, such as a family emergency or personal injury. 

4. Risk and liability 

You and all group members are required to read and acknowledge your agreement to conditions set out in Tūtira’s risk management documentation and personal waiver prior to commencing your experience. This information will be presented to you on arrival at your selected experience. 

You acknowledge and accept the risks and responsibilities associated with participation in your chosen Tūtira experience, which may result in property damage/loss or serious/fatal injury. While Tūtira has in place a number of measures to limit personal risk, you understand that our experiences take place in remote areas without fast access to full medical facilities and risks from stock, wildlife, rocks, cliffs, mechanical failure, illness or accident, changing weather conditions and other circumstances not specified are ever-present hazards. 

Tūtira, including any and all of its employees, managers, directors, shareholders, subcontractors, experience partners and their employees (together, the “Related Parties”), is not liable, to the maximum extent permitted by law, for any loss or harm you or any group member may suffer. You agree to indemnify and hold harmless Tūtira and all Related Parties from any and all losses or liability arising directly or indirectly out of, or in connection with participation in the experience.

Notwithstanding anything else contained in this agreement, Tūtira’s liability to your or any group member shall not in aggregate exceed the individual amount paid for the experience. 

5. Force Majeure

If we are prevented, despite exercising due care, from providing the experience or performing any of our obligations under this agreement by reason of natural or regional disaster or act of God, national or regional state of emergency, unavoidable mechanical failure or breakdown, government or political action, civil unrest, epidemic or pandemic, acts of terrorism, acts or omissions or any other cause out of our reasonable control we will be under no liability to you or any other group member and may cancel the experience or make either delayed or alternative arrangements.

In the event of a cancellation due to a Force Majeure event, you will be entitled to a refund in accordance with our cancellation and refunds policy (2.). 

6. Privacy Policy

You and all group members agree to the conditions set out in our Privacy Policy.

7. General

You agree to comply with all experience rules and the direction provided to you by the Tūtira guide. We reserve the right to dismiss you or any group member from the experience at any time in the event that experience rules, guide directions or these Terms and Conditions are breached.

Group members are required to be over 16 years of age and hold, at a minimum, a valid learner driver's licence or equivalent.   

We reserve the right to use your feedback submitted, and images taken during the experience or shared with Tūtira by email, direct message or social media without specific consent or compensation to you for the purposes of publicity and marketing.

We reserve the right to amend our Terms and Conditions and Privacy Policy from time to time.

These Terms and Conditions and the service provided pursuant to these Terms and Conditions will be governed by the laws of New Zealand and the parties submit to the jurisdiction of New Zealand courts.
